A supplementary affidavit on behalf of the petitioner has been filed.

The petitioner seeks bail in Hajipur Town P.S. Case No. 872/14 instituted under section 379 and 307/34 IPC. Both parties, it is submitted, are Pattidar and there is serious land dispute between them. According to the informant when he was returning back home and reached his Darwaza it is alleged that the petitioner along with his brothers and two others named therein armed with pistol(s) arrived at the scene of occurrence. On the order given by the petitioner the accused persons assaulted him with sickle and fists and slaps.

No.10626 of 2015 (2) dt.18-05-2015 2 / 2 Learned counsel for the petitioner submits that the petitioner has been implicated in this case due to land dispute and is in jail custody since 26.11.2014. Both parties have compromised and an application to this effect has been filed. In the facts and circumstances of the case, the petitioner abovenamed is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Town P.S. Case No. 872/14 on condition that one of the bailors shall be his own/close family member. In the event of framing of charge the petitioner shall appear in person on each date fixed at the trial. Failure in appearance on two consecutive dates shall lead to cancellation of his bail bonds. (Kishore Kumar Mandal, J) HR/- U
