The petitioners apprehend their arrest in connection with Dariyapur P.S. Case No. 137 of 2013 registered for the offences punishable under Sections 147, 148, 342, 323, 332, 353, 307, 379, 424 and 504 of the Indian Penal Code. It is submitted on behalf of the petitioners that there is no specific allegation against the petitioners, save and except, the fact that they were part of the crowd, who protested against the illegal act of the police in releasing the vehicle which had caused to accidental death of small
Patna High Court Cr.Misc. No.39986 of 2014 (2) dt.25-03-2015 2/2 boy of the village. It is further submitted that since police official had not discharged their official duty properly, there was much anguish amongst the villagers and they had gathered together to protest against the same but the police had badly beaten the petitioners.
Considering the aforementioned submissions and also the nature of allegation, let the petitioners, in the event of their arrest or surrender before the court below within a period of two weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sri. P.K. Choudhary, Judicial Magistrate, 1st Class, Saran at Chapra in connection with Dariyapur P.S. Case No. 137 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
