Heard both sides.

The petitioner apprehends his arrest in a case under section 308 and other sections of the I.P.C.

The petitioner is alleged to have assaulted the informant with knife which hit on the index finger of the informant and son of the informant is alleged to have been assaulted by the petitioner.

Learned counsel for the petitioner submits that after three days of the occurrence, the F.I.R. was lodged. The injuries are simple in nature. Co-accused Dharmendra Singh has already been enlarged on anticipatory bail. On account of assault made by the petitioner with knife, the injury was found on the index finger. The case is compromised.

Considering the facts that simple injury is caused to the informant, the petitioner is directed to surrender in the court below within four weeks and the court below shall enlarge the petitioner on bail on furnishing bail bond of Rs.10,000/- (ten

Patna High Court Cr.Misc. No.39075 of 2014 (3) dt.24-03-2015 thousand) with two sureties of the like amount to the satisfaction of the court below, subject to the condition as laid down under Section 438 (2 ) of the Cr.P.C.
