====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 15-09-2017 Heard Sri Rakesh Singh , learned counsel for the petitioner and Smt. Anita Kumari, learned Additional Public Prosecutor.
The sole petitioner, who is in custody since 15.07.2017 in Dehri (T) P.S. Case No. 525 of 2017 registered for the offence under Section 30(a) , 38 (i)(ii), 41(i)(ii) of the Bihar Prohibition and Excise Act , 2016 has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner was shown as if he was moving on a tempo and after seeing police he started fleeing away where after from the said tempo recovery of about 140 liters of country made liquor was shown. It has been argued that though petitioner was arrested from his garment shop it was shown as if petitioner was arrested while fleeing away. Learned counsel for the petitioner
Patna High Court Cr.Misc. No.41454 of 2017(2) dt.15-09-2017 2/2 has also argued that seizure of the said liquor was effected in violation of section 100 of the Code of Criminal Procedure, 1973.
Considering the nature of accusation as well as period of custody, let the petitioner Ajeet Kumar @ Ajit Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - IIcum- Special Court, Excise, Rohtas / concerned court in connection with Dehri ( T) P.S.
