The petitioners are languishing in custody since 02.094.2015 in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504 and 506/34 of the Indian Penal Code.

It is alleged that petitioner no. 1 Baijnath Yadav assaulted with Farsa on the head of the informant and Guriya Kumari cut his left wrist whereas petitioner no. 3 Mahesh Yadav assaulted on the right hand of the informant by lathi when sons of the informant, namely, Vijay Yadav and Sanjay Yadav

Patna High Court Cr.Misc. No.24265 of 2015 (2) dt.20-07-2015 2/2 came to rescue then petitioner no. 2 Lalu Yadav assaulted with Farsa on the head of the son of the informant Sanjay Yadav. It is also alleged that the accused persons also snatched silver chain of the son of the informant Sanjay Yadav and cash of Rs.3,000/- and 5,000/- from the pocket of Sanjay Yadav and informant. It is submitted by learned counsel for the petitioners that the injuries have been found to be simple when there is a counter version of the occurrence also and investigation has already concluded.

A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Araria in connection with Narpatganj P.S. Case No. 134 of 2015.
