This application for anticipatory bail arises out of Choraut P.S. Case No. 33 of 2019, disclosing offences under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.
Learned counsel, appearing on behalf of the petitioner, has submitted that there has been inordinate delay of nearly ten days in lodging of the FIR, which has been registered on 03.05.2019 for the alleged occurrence said to have taken place on 24.04.2019. He has also submitted that, though there is allegation of assault made by a sharp-cutting weapon, the injury has so far been found to be simple in nature. Considering the above submission, this application is
Patna High Court CR. MISC. No.52441 of 2019(2) dt.22-08-2019 2/2 allowed. Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned S.D.J.M., Pupri, Sitamarhi in connection with Choraut P.S. Case No. 33 of 2019, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
