The petitioner apprehends his arrest in Bihpur P.S. Case No. 349 of 2022, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act. Total 216.440 litres of illicit liquor has been recovered from railway line and from one vehicle.

It is submitted that nothing has been recovered from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in question.

Counsel for the State vehemently opposed the bail application and submitted that petitioner has got three criminal antecedents, out of which two cases are of Excise Act. Considering the criminal antecedents of similar
