That this application is being filed for issuance of a writ in the nature of mandamus commanding and directing the respondents authority to remove the encroachment made over the Government land, bearing Khata No. 464, Plot No. 1832, total area ad-measuring about 17 Decimal of Mauza- Piroo, situated at villagePiroo, P.O.-Piroo. P.S.- Haspura, Daudnagar, District-Aurangabad, the nature of the said land is

Patna High Court CWJC No.12498 of 2024(2) dt.22-08-2024 2/2 'Gairmazarua Aam', ('Chiraree') & meant for the purpose of 'Bury & Burn' of the dead bodies and in the column of the 'Rayat', in the Kathiyan, it is mentioned as 'Chaah Pokthha' (Concrete-well), Garmazarua, which is used for general people. (B). Further for directing the respondents to remove the said encroachment, after disposing the Encroachment Case No. 1015/2023, filed on 28.07.2023, before the Sub-Divisional Magistrate, Daudnagar, Aurangabad, as early as possible."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the Circle Officer, Huspura, Daudnagar, District-Aurganabad, for redressal of his aforesaid grievances. Liberty, so sought, is granted. 3.
