JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have been arrested by the police while he and others had assembled to make preparation for committing dacoity and on search, one country made katta and one live cartridge were recovered from conscious possession of the petitioner. Petitioner does have criminal antecedent of three cases but submission on behalf of the petitioner is that in all the above stated cases, neither petitioner was named nor anything had been recovered from his possession and, as a matter of fact, when he was caught in connection with the present case, police implicated the petitioner in the aforesaid cases.
Accordingly, let the petitioner, above named, be
Patna High Court Cr.Misc. No.40460 of 2016 (2) dt.30-09-2016 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI Saran at Chapra in connection with Nayagaon P.S.case No 32 of 2016.
