Petitioner is accused in connection with N.D.P.S. Case No. 138 of 2011 arising out of Turkauliya P.S. Case No. 426 of 2011 registered under sections 21 and 22 of the N.D.P.S. Act. Earlier, prayer of the petitioner for bail was rejected vide Cr. Misc. No. 26645 of 2013 on 10.01.2014 with direction to conclude the trial preferably within a period of one year. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and is in custody since 13.07.2012. The report, as called for from the 3rd Addl. Sessions Judge, East Champaran, Motihari through letter no. 191 dated 20.04.2015, discloses that out of 10 charge-sheeted witnesses, uptill-now five prosecution witnesses have been examined and the

Patna High Court Cr.Misc. No.6638 of 2015 (3) dt.20-05-2015 2/2 informant and other witnesses, including I.O. are still to be examined by the prosecution.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of VIIIth Addl. Sessions Judge, East Champaran in connection with N.D.P.S. Case No. 138 of 2011 arising out of Turkauliya P.S. Case No. 426 of 2011. Out of two sureties, one surety must be parents/close relative of the petitioner.
