The petitioner seeks bail in Kanti (Panapur O.P.) P.S. Case No. 93 of 2016, instituted for the offence under Section(s) 302, 120B/34 of Indian Penal Code and Section 27 of the Arms Act.

It is alleged in the written report that there is specific allegation of causing firearm injury to Munna Rai on his head, temple and chest against co-accused Deepak Ram, Santosh Ram and Ram Babu Rai. It is further alleged that petitioner used to come on Motorcycle to the house of the informant. Petitioner has friendly relationship with co-accused Ram Babu Rai.

No.53208 of 2019(2) dt.30-08-2019 2/2 Counsel for the petitioner submits that informant has raised suspicion that petitioner along with other accused after hatching conspiracy, committed murder of son of the informant. Besides suspicion, there is no allegation of any specific overt act against the petitioner.

Petitioner is in custody since 10.6.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, West, Muzaffarpur, in connection with Kanti (Panapur O.P.) P.S. Case No. 93 of 2016, subject to the condition that both the bailors will be close relatives of the petitioner.
