The petitioner seeks bail in a case registered under Sections 385 and 387 of the IPC.
The informant informed the police that from Mobile No.7610538798, a call was made on mobile no.9431212004 belonging to Smt. Renu Devi, M.L.A. of Bettiah Constituency demanding Rs.50,00,000/-.
It is submitted that from perusal of para-11 of the case diaryit appears that the Investigating Officer got the CDR of Sim No.7061538795, which number was not mentioned in the FIR and the Sim number mentioned in the F.I.R. stands in the name of one Hari Lal Yadav, who disclosed that the petitioner got his Sim blocked and activated the same in his own name but no documentary proof is placed before the police during the course of investigation. Except the confessional statement of the petitioner, no tangible evidence is on the record. From the possession of the petitioner, one Pulsar Motorcycle and mobile
Patna High Court Cr.Misc. No.11842 of 2015 (3) dt.20-05-2015 2/2 of Samsung having Sim no.72778791 and 993494004 were recovered. The Sim recovered from the possession of the petitioner does not bear the number mentioned in the F.I.R. Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah (Mufassil) P.S.Case No. 62 of 2015.
