JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Korha P.S. Case No. 214 of 2019 registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.

Prosecution case is of kidnapping of daughter of the informant aged 15 years by the petitioner. It further appears that in her statement under Section 164 Cr.P.C. the victim girl named this petitioner as the person who has kidnapped her. Submission of learned counsel for the petitioner is that the FIR and her statement recorded under Section 164 Cr.P.C. are contradictory to each other.

Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner stating that the girl is minor and she has supported the allegation in her statement under

Patna High Court CR. MISC. No.52662 of 2019(2) dt.23-08-2019 2/2 Section 164 Cr.P.C. and as such petitioner does not deserve anticipatory bail.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner.

Accordingly, this application is dismissed.
