The petitioner is in custody since 10.07.2014 in connection with Goraul P.S. Case No. 187 of 2014 for the offence registered under Sections 20 (B) (I)/23/29 of the N.D.P.S. Act.
The allegation against the petitioner is that a Pickup van bearing Registration NO. B.R. 31G-7594 was intercepted and in the said Van, two gunny bags of ganja were recovered. Learned counsel for the petitioner submits that the said recovery was not from the conscious possession of the petitioner. He had merely brought the Pickup Vain to communicate from one place to another. It is further submitted that the similarly situated person who has been arrested from the Van has been extended the
Patna High Court Cr.Misc. No.12343 of 2015 (3) dt.21-05-2015 privilege of regular bail by this Court on 02.03.2015 in Cr. Misc. No. 37251 of 2014. It is further submitted that the seizure list does not bear the signature of the petitioner.
Considering the aforesaid submissions and also the fact that the petitioner have no criminal antecedent, let the petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge NDPS Act-cum-Sessions Judge, Vaishali at Hajipur in connection with Garaul P.S. Case No. 187 of 2014.
