2. This is an application for transfer of Matrimonial case being Divorce Case no. 457 of 2021 from the court of learned Principal Judge, Family Court, Muzaffarpur to the court of learned Principal Judge, Family Court, Patna.

3. Pursuant to the notice issued the husband/ Opposite Party has appeared.

4. The lady has assigned the reasons in paragraphs 6 to 8 of the petition which read as follows:- "6. The petitioner is a lady dependent upon her own old and ailing parents.

7. That the petitioner is no longer staying in Muzaffarpur and has moved to

Patna High Court MJC No.1886 of 2022(3) dt.12-09-2024 2/2 Patna and residing here. It is causing much inconvenience to her to travel to Muzaffarpur from Patna to contest these cases.

8. The petitioner is having her permanent residence at Patna and has also got her minor child admitted in a school at Patna.

5. Learned counsel for the Opposite Party submits that he may be allowed to appear either physically or through video conferencing.

6. The prayer/submission is just and proper, if the case is to be transferred, the husband also must get opportunity to appear either physically or through video conferencing.

7. In that background, M.J.C. No. 1886 of 2022 is allowed.

8. Let the files of Divorce Case no. 457 of 2021 be transferred from the court of learned Principal Judge, Family Court, Muzaffarpur to the court of learned Principal Judge, Family Court, Patna with permission to both the parties either to appear physically or through the video conferencing.
