ANJANA PRAKASH ORAL JUDGMENT Date: 21-05-2015 The Petitioner seeks quashing of the order dated 18.3.2015, by which the 2nd Additional Sessions Judge, Naugachia, Bhagalpur has refused an application for calling for the Station Diary in Sessions Trial No.748 of 2013 arising out of Naugachia P.S. case No.48 of 2013).
The Petitioner wanted to bring the Station Diary entry on record to show that he had never made a confession.
I find from the impugned order that the prayer was refused for the reason that the recovered article was never brought on record by the prosecution, under which circumstances the fact that the Petitioner had ever confessed before anyone has no meaning. Hence, the application stands dismissed.
