This is an application for bail in connection with Malsalami P.S.Case No. 04 of 2017 registered for the offences punishable under Section 370 of the Indian Penal Code. Allegation against the petitioner as per FIR is that he enticed the daughter of the informant and taken her away for sale to some other accused persons.
Submission of learned counsel for the petitioner is that the statement of the victim girl shows that she married with a person and is living happily and now petitioner is in custody for seven months.
Heard learned APP also, who has opposed the prayer for bail stating that statement of the girl shows that one Birendra
Patna High Court Cr.Misc. No.45995 of 2017 (3) dt.11-10-2017 2/2 Kumar and the petitioner had taken her to Agra for the purpose of sale.
Having heard both sides and in view of the allegation, I am not inclined to grant bail to the petitioner. However, once charge has been framed in this case, the court below will release the petitioner on bail to its own satisfaction, if an application is filed on behalf of petitioner for bail, on the condition that he will co-operate in trial. With the above observation, this application is disposed of.
