Petitioner seeks bail in a case registered for the offences punishable under Sections 457, 341, 323, 376, 504/34 of the Indian Penal Code.
Allegation against the petitioner is that he ravished to the informant. The informant supported the aforesaid allegation in her statement under Section 164 Cr.P.C. The sister of the informant had also supported the allegation. The petitioner is in custody since 18.09.2016. Earlier, prayer for bail was refused vide Annexure-1 on 13.01.2017 with liberty to renew the prayer, if the trial is not concluded within one year from the date of communication of the order to the learned Trial Judge. The
Patna High Court Cr.Misc. No.47290 of 2017 (6) dt.21-03-2018 report of the learned Trial Judge dated 13.02.2018 would reveal that the case is still pending for completion of prosecution evidence.
Considering the period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.T. No.35 of 2017 arising out of Baisi Police Station Case No.73 of 2016, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
