Mr.Sanjay Kumar Sharma, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 10-09-2025 Heard learned counsel appearing on behalf of the petitioners; learned counsels for the informant and the learned APP for the State.
2. Petitioners seek pre-arrest bail in connection with Chapra Muffasil P.S.Case No.259/2025, registered for the offences punishable under Sections 126(2), 115(2), 117(2), 109, 74, 352, 3(5) of BNS.
3. As per the allegation made in the FIR, all the accused persons including the petitioners entered into the house of the informant and they abused them and upon restrain to the same, all the accused persons named in the FIR along with the
Patna High Court CR. MISC. No.55984 of 2025(2) dt.10-09-2025 2/3 petitioners assaulted on the vital part of the body of the informant and his other family members with an intention to kill them.
4. Learned counsel appearing on behalf of the petitioners submitted that there is a land dispute between the parties and only to pressurize the petitioners, the present case has been lodged. He further submitted that the injuries have been found by the Doctor to be simple in nature. Petitioners have clean antecedent.
5. Learned APP for the State have vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.
6. Having considered the rival submissions made on behalf of the parties, as well as, considering the fact that the petitioners are ladies, they are directed to be released on prearrest bail, in the event of his arrest or surrender before the learned district court within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra/concerned court, in connection with Chapra Muffasil P.S.Case No.259/2025, subject to conditions as laid down under Section 482(2) of BNSS of 2023
7. The learned district court is directed to verify the
Patna High Court CR. MISC. No.55984 of 2025(2) dt.10-09-2025 3/3 criminal antecedent of the petitioners and if it is found that the petitioners are involved in some other cases as what has been stated in paragraph No.3 of the bail application, this order will automatically lose its force.
