2. The petitioner is apprehending his arrest in a case in connection with Bidupur P.S. Case No. 374 of 2023 dated 01.07.2023 registered for the offences punishable u/ss 363 and 366A of the Indian Penal Code.

3. As per the prosecution case, the petitioner, Amit Kumar is alleged to have kidnapped the minor daughter of the informant with the assistance of the other co-accused person by enticing her for the purpose of marriage.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

The victim was not forced to have illicit intercourse with another person. The victim in her statement recorded u/s 164 of the Cr.P.C. has not made any allegation of sexual assault against the petitioner. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. Similarly situated co-accused has already been granted anticipatory bail by this court vide order dated 14.03.2024 passed in Cr. Misc. No. 11050 of 2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the nature of allegation against the petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned court concerned, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 374 of 2023, subject to conditions as laid down under Section 482(2) of the BNSS, with further condition/s:- (i). The petitioner is directed to remain physically
