The petitioner is languishing in jail custody for more than one year in a case registered under Section-307 & other minor sections and 27 of the Arms Act.

No doubt, earlier prayer for bail of the petitioner was rejected by this court but learned trial court has reported that four prosecution witnesses are still to be examined. Co-accused, Nitish Kumar against whom there is allegation of causing fire-arm injury on the testical and thigh of the informant, has already been granted privilege of bail by the learned trial court itself. Allegation against petitioner is that his firing caused injury on the hands of the informant.

Considering the above-said facts and circumstances

Patna High Court Cr.Misc. No.41879 of 2016 (3) dt.26-10-2016 2/2 of the case as well as period of detention of the petitioner in jail custody coupled with the allegation levelled against him, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bakhtiyarpur P.S. Case No. 216 of 2013 corresponding to Sessions Trial No. 759 of 2015 to the satisfaction of learned Additional Sessions Judge-Ist, Barh. (Hemant Kumar Srivastava, J) A.K.V./- U T
