The petitioner is languishing in custody in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

The accusation is of robbing cash of Rs. 13,340/- and articles worth Rs. 14,322/- of the informant by unknown criminals.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The F.I.R is against unknown. The name of the petitioner sprang up on the

Patna High Court CR. MISC. No.59296 of 2022(2) dt.04-02-2023 2/2 confessional statement of co-accused Kanhaiya Kumar in Maheshkhunt P.S. Case No. 94 of 2021. The petitioner was not apprehended fro the spot. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is in custody since 07.06.2022. A statement has been made in para 3 of the petition that petitioner is accused in one other case apart from the present one.

In the facts and circumstance of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Khagaria in connection with Maheshkhunt P.S. Case No. 91 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
