The petitioner seeks bail in a criminal prosecution registered under Section 307 and some other allied offences under the Indian Penal Code.
Taking into consideration the fact that the petitioner is alleged to have assaulted the informant by Dabia (a heavy sharp cutting weapon) on his neck causing injuries on the vital part of his person and further taking into consideration the fact that the case of the petitioner has, now, been committed to the court of Session, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of bail in connection with Sessions Case No.121 of 2014 arising out of Saur Bazar P.S. Case No. 563of 2013 pending in the court of learned 3rd Additional Sessions Judge, Saharsa, at this stage and it is accordingly rejected for the present.
Learned trial court is hereby directed to take up the trial of the petitioner on priority basis and, if the charge has not already been framed against the petitioner, then the same shall be framed
Patna High Court Cr.Misc. No.11845 of 2015 (3) dt.26-05-2015 without any unnecessary further delay. However, if the trial of the petitioner is not concluded within a period of nine months from the date of framing of charge, without there being any fault on his part, then he shall be at liberty to renew his prayer for bail.
