JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-47, 48, 49 of the Excise Act.

The petitioner is languishing in jail custody since 2804-2016 on the accusation that he was caught by the police, when having got confidential information, police raided dilapidated house and 20 litres illicit Mahua liquor, several empty bottles and 70 litres liquor like liquid, were recovered from the aforesaid dilapidated house.

Submission on behalf of the petitioner is that petitioner was caught on mere suspicion and as a matter of fact, the said dilapidated house does not belong to the petitioner. It is further

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Barh P.S. Case No. 146 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Barh. (Hemant Kumar Srivastava, J) A.K.V./- U T
