ANJANA MISHRA ORAL ORDER 26-05-2015 Heard learned counsel for the petitioner and the learned counsel for the State.
The petitioner is in custody since 9.2.2015 in connection with Mokama P.S. Case No.19 of 2015 registered for the offences under Sections 457 and 380 of the Indian Penal Code. Learned counsel for the petitioner submits that though the alleged theft had occurred in the month of December, 2014 itself, yet the F.I.R. was lodged on 7.2.2015 after 48 days, for which there is no plausible explanation. Learned counsel further submits that it is only on suspicion that the petitioner's name has been brought into this case. It is further submitted that other coaccused Mamta Kumari @ Mamta Devi has been extended the privilege of bail by a Bench of this Court in Cr.Misc. No.14126 of
Patna High Court Cr.Misc. No.11701 of 2015 (3) dt.26-05-2015 2/2 2015, vide order dated 23.4.2015.
Considering the aforementioned submissions and also the fact that the petitioner has no criminal antecedents, let the above named petitioner be released on bail on her furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Ashutosh Kumar, learned Judicial Magistrate, Barh, Patna, in connection with Mokama P.S. Case No.19 of 2015.
