ANJANA MISHRA ORAL ORDER 26-05-2015 Heard learned senior counsel for the petitioner and learned counsel for the State.

The petitioner is in custody since 10.02.2015 in connection with Chenari P.S. Case No. 09 of 2015, registered for the offences punishable under Sections 307, 341, 323, 504, 325 and 384/34 of the Indian Penal Code.

Learned senior counsel for the petitioner submits that though the date of occurrence is 06.01.2015 yet the F.I.R. of the present case has been registered on 09.01.2015. However, it is strange that the doctor has given his injury report dated 06.01.2015 on which date even the F.I.R. had not been registered. It is further submitted that the petitioner has no criminal antecedent and has been languishing in custody only on account of

No.11833 of 2015 (3) dt.26-05-2015 2 / 2 frivolous allegation made against him and even then the injury report does not indicate as to on which part of the body of the informant the injury purported to have been made. Considering the aforementioned submissions, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Rohtas at Sasaram, in connection with Chenari P.S. Case No. 09 of 2015.
