The name of petitioner came in this case in confessional statement of co-accused and one mobile of Lava company is said to have been recovered from conscious possession of the petitioner but submission on behalf of the petitioner is that the aforesaid mobile is not the stolen property of the present case and as a matter of fact, petitioner was arrested in connection with another case and has been made accused in this case.
