ANJANA MISHRA ORAL ORDER 26-05201506.01.20 Heard learned counsel for the petitioners and learned counsel for the State in both the cases as both the cases arise out of same P.S. Case number, they have been heard together. The petitioners are in custody since 15.11.2014 in connection with Risiup P.S.Case No.37 of 2014 registered under Sections 395 and 412 of the Indian Penal Code. Learned counsel for the petitioners submits that the names of the petitioners have been brought into the case on the
Patna High Court Cr.Misc. No.12266 of 2015 (2) dt.26-05-0201 2/2 basis of confessional statement made by one Raj Mani Singh, who was arrested by the police, while he was running away with the truck, which was apprehended by the police and the driver and khalasi had been tied and the truck had been taken away by said Raj Mani Singh. Learned counsel for the petitioners further submits that these two petitioners were brought into the case on the basis of confessional statement of Raj Mani Singh. It is further submitted that third accused who was said to be apprehended on the vehicle, which was following the truck and his name has been taken along with the petitioners, has been extended privilege of regular bail by this court vide order passed in Cr.Misc.No.
8556 of Considering the aforesaid submissions, let the petitioners (1) Vijay Yadav @ Sanjay Yadav, (2) Ram Babu Srivastava be released on bail on furnishing bail bonds of Rs/10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Risiup P.S.Case No.37 of 2014.
