Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Chhatauni P.S. Case No. 252 of 2022 lodged under Sections 302, 201/34 of the I.P.C.

As per the prosecution case, there are 7 named and unknown accused persons in the F.I.R. A long F.I.R. indicating the conspiracy in commission of death of deceased namely Maharana Pratap Singh @ Nami Singh @ Rahul Singh is there. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.55996 of 2022(3) dt.22-02-2023 2/3 dead body of the deceased was recovered and U. D. Case was registered. Subsequently, F.I.R. was lodged and investigation started and on the basis of suspicion, the name of the petitioner figured in this case.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 11.07.2022 having clean antecedent. He further submits that there is no direct allegation or any witness of the said occurrence. A circumstance has been developed in the F.I.R. by narrating a story, under which the suspicion has been developed against the petitioner that he has killed the deceased, along with other accused persons.

Learned counsel for the State opposes the prayer for bail but admits that the angle of conspiracy is there in the F.I.R. and it can be ascertained only in the trial.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Chhatauni P.S. Case

Patna High Court CR. MISC. No.55996 of 2022(3) dt.22-02-2023 3/3 No. 252 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
