2. Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 342, 307 and 504/34 of the Indian Penal Code.
3. Learned counsel appearing on behalf of the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that on 11.06.2023 at about 08:00 a.m. while he was filling soil on his land when the accused persons including the petitioners came armed with Lathi and ro and assaulted the informant, further Srikant
Patna High Court CR. MISC. No.58318 of 2025(2) dt.08-09-2025 2/3 assaulted the informant by Rama causing injury on head, other co-accused also assaulted with Rama and Lathi.
4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in the instant case by the informant on account of dispute relating to land. It is also submitted that specific allegation of assault is against Srikant. It is further submitted that even presuming what has been alleged is true without admitting then injury suffered by the informant is simple in nature as would manifest from Annexure-2 to the anticipatory bail application. It is further submitted that Paraiya P.S. Case No.233 of 2023, dated 11.06.2023 has been instituted by the side of the petitioners against the informant and others.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by learned counsel for the petitioners, let petitioners, above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Paraiya
