JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2015 Heard the learned counsel for the petitioner as well as the learned for the State.

The petitioner is languishing in custody since 17.01.2015 in a case registered for the offences punishable under sections 353, 324, 326, 307/34 of the I.P.C, and section 27 of the Arms Act.

It is alleged that three persons scuffled with the gate man of railway crossing when one of them fired which hit on the right hand of the gate man and subsequently one Chhathu Sahni was apprehended who disclosed the names of petitioner and Muzibur Rehman.

It is submitted by learned counsel for the petitioner that except the confessional statement of co-accused Chhathu

No.26240 of 2015 (2) dt.27-07-2015 2/2 Sahni there is no evidence to the effect that the petitioner had actually fired and only one grievous injury has been found on the hand. The petitioner was not put on test identification parade. It is further submitted that the investigation has already concluded. Considering the fact that petitioner was not put on T.I. parade, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar III, J.M. 1st Class, Katihar in Barari P.S. Case No. 121 of 2014.

Considering the criminal antecedent of the petitioner, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults on two consecutive occasions or substantially gets involved in some serious nature of offence.
