ANJANA MISHRA ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 03.04.2017 in connection with a case registered for the offences punishable under Sections 414of the Indian Penal Code and 25(1-b) a/26/35 of the Arms Act.

Learned counsel for the petitioner submits that so far as the seized motorcycle is concerned, the said belongs to his brother for which the requisites papers are available. As far as recovery of arms is concerned, the petitioner squarely denies the same and submits that he has already been in custody for more than 5 1⁄2 months.

Taking into consideration the facts and

No.41104 of 2017 (2) dt.20-09-2017 2/2 circumstances that the motorcycle which belongs to the brother of the petitioner, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Begusarai, in connection with Birpur P.S. Case No. 35 of 2017.
