The petitioner is languishing in custody since 25.04.2015 in connection with Dandkhora P.S. Case No. 17 of 2015 for the offences instituted under Section 392 of the I.P.C. The prosecution story, in brief, is that on 17.03.2015 when the informant was crossing Sonaili Bazar with his colleague, suddenly two unknown persons overtook them and on the point of assault looted Rs. 19,500/- and three mobiles from their possession and also looted A.T.M. Card and withdrawn the amount Rs. 15,500/-.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.04.2015 and the charge sheet has
Patna High Court Cr.Misc. No.25428 of 2015 (3) dt.02-09-2015 2/2 been submitted in the present case. It is further submitted that the petitioner is not named in the F.I.R. It is further submitted that there is no T.I.P. conducted to ascertain the implication of the petitioner in the present case. Other co-accused has been granted bail vide Cr. Misc. No. 24691 of 2015.
On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Katihar, in connection with Dandkhora P.S.
