Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the Informant.

The petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent. It is next submitted that co-accused, Vishal Kumar, had approached this court seeking regular bail by filing Cr. Misc No. 49176 of 2024 and the same was allowed by an order dated 3-9-2024, further Rajkumar Thakur @ Raj Karan Thakur had also approached this Court seeking anticipatory bail by filing Cr. Misc No. 42520 of 2024 and the same was allowed by an order dated 3-9-2024. It is next submitted that while granting regular
Patna High Court CR. MISC. No.58858 of 2024(2) dt.22-11-2024 2/2 bail and anticipatory bail to Vishal and Rajkumar Thakur, this Court had considered the case on merit and in detail. 4.
It is next submitted that name of the petitioner transpired in the confessional statement of Vishal. It is also submitted that in the nature of allegation as alleged in the FIR, it does not appear probable that a health worker would have been extorted by the accused persons including the petitioner of lakhs and lakhs of rupees. 5.
Learned A.P.P. for the State and learned counsle appearing on behalf of informant opposes the prayer for bail of the petitioner but then are not in a position to rebut the submission made by learned counsel for the petitioner that Vishal and Rajkumar have been granted the privilege of regular bail and anticipatory bail. 6.
Considering the submission made by learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Gopalpur P.S. Case No. 773 of 2023.
