JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 01-10-2015 Petitioner is a PDS dealer bearing License no. 5N/92. He seeks quashing of the orders of the Licensing officer dated 17.4.2012 and the appellate authority dated 19.10.2013, by which his PDS license has been cancelled.

The petitioner submits that the points raised by him in show cause reply was not addressed by the Licensing officer as well as the appellate authority. Further, only few persons had filed complaint against him, against whom his family members had lodged a criminal case. Petitioner has further referred to Annexure 11 to the suppl. affidavit wherein he states that some of the complainants have denied that they have made any allegation against him.

In my view, as the petitioner has alternative remedy of

Patna High Court CWJC No.16595 of 2014 (4) dt.01-10-2015 2/2 revision, the writ petition is disposed of with liberty to seek the remedy of revision.

In case, petition for condonation of delay is filed, the same would be considered sympathetically, as the petitioner was pursuing the remedy before this Court. It is expected that the revisional authority will dispose of the revision application preferably within three months of its filing. Respondents would furnish a copy of the enquiry report.
