JUSTICE SUDHIR SINGH ORAL ORDER 17-10-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 406, 420, 504 and 506/34 of the Indian Penal Code and Sections 3 / 4 of the Dowry Prohibition Act.

Allegation against petitioners is that due to non-payment of additional demand of dowry they refused to marry daughter of informant.

It has been submitted on behalf of the petitioners that they are in custody since 8.9.2016, Petitioners have got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioners. Petitioner no. 2 is a Government employee. The allegation made by informant is without any substance. There is no documentary evidence to suggest any money transaction between the parties. Petitioners have falsely been implicated in the present case.

On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail

Patna High Court Cr.Misc. No.44409 of 2016 (2) dt.17-10-2016 2/2 bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Pauthu P.S. Case no. 38 of 2016.
