Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Khajauli P. S. Case No. 71 of 2022 corresponding to G.R. No. 62 of 2022 registered for the offences punishable under Sections 366(A), 379 and 34 of the Indian Penal Code and Sections 8 and 12 of POCSO Act.

As per the prosecution, the informant alleged that this petitioner with help of co-accused persons eloped with her daughter along with Rs. 2,50,000/- cash and some jewelleries.

No.57516 of 2022(3) dt.21-02-2023 2/2 The main submissions advanced by the learned counsel Mr. Prabhakar Thakur for the petitioner are that the petitioner has been languishing in jail since 08.05.2022 having fair and clean antecedent and he is a co-villager of the so-called victim and as per the AADHAR Card of the victim, her age is 20 years and she has been recovered and recorded her statement under section 164 of Cr.P.C. in which she flatly denied the allegations of the FIR and accepted her love affair as well as matrimonial relationship with this petitioner. Learned APP Mr. Uday Chand Prasad appearing for the State has opposed the bail prayer.

In view of the facts, as stated above, this court is inclined to accept petitioner's bail prayer. Accordingly, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Khajauli P. S. Case No. 71 of 2022.
