The prayer for bail on behalf of the petitioner was earlier rejected on the ground that the petitioner has been identified in the Test Identification Parade directing the trial Court to expedite the trial for early disposal of the case within six months and if the trial is not concluded within the aforesaid period then the petitioner may renew his prayer for bail. Learned counsel for the petitioner submits that the identification of the petitioner is only by one person and similarly situated co-accused, having similar allegation, has been granted bail vide order dated 14.07.2014 passed in Cr. Misc. No. 9263 of 2014.
Patna High Court Cr.Misc. No.41697 of 2014 (5) dt.17-02-2016 Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Tekari P.S. Case No. 340 of 2012, subject to the condition that the petitioner shall not indulge in such type of activity in future and he will file Hazri in the nearest police station once in a fortnight for six months and if any report is received regarding his involvement then the trial Court shall proceed to cancel the bail bond of the petitioner.
