The petitioner seeks bail in Pakribarawan P.S. Case No. 103/2014, registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act. The informant woke up after hearing the sound of crying of his maternal grand mother. The informant caught Jitu Vishwakarma then he inflicted with sickle on the informant and the informant sustained injury on his palm. Jitu Viswakarma had already cut the neck of his maternal grand mother. The informant further disclosed that he saw Sitaram Vishwakarma and Raushan Vishwakarma fleeing away from the place of occurrence. It is submitted that the informant did not make any

Patna High Court Cr.Misc. No.25445 of 2015 (2) dt.22-07-2015 2/2 allegation of assault either against Sitaram Vishwakarma or against Raushan Vishwakarma, the petitioner.

Sitaram Vishwakarma has already been enlarged on bail vide order dt. 15.05.2015 Passed in Cr. Misc. No. 2663 of 2015. The case of the petitioner stands on the same footing.

Learned Additional PP as well as learned counsel for the informant did not dispute the facts.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Nawada, in connection with Pakribarawan P.S. Case No. 103/2014.
