JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-09-2019 This application, for grant of anticipatory bail, arises out of Hajipur Sadar P.S. Case No. 153 of 2019, disclosing offences under Sections 399, 402, 414, 120(B) of the Indian Penal Code and Section 26(1-b)a, 26/35 of the Arms Act. Prosecution case is that police on information that some miscreants have assembled to commit robbery raided the place and the accused persons tried to flee away, however, some of them were caught and there is recovery of one country made pistol from their possession and they disclosed the name of petitioner as their associate.

Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been implicated in this case only on the basis of apprehended coaccused and except that there is nothing against the petitioner.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Sadar P.S. Case No. 153 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
