The petitioner is in custody in a case registered under Sections 341, 342, 323, 376(1) of the Indian Penal Code and Sections 3,4 and 6 of the Protection of Children from Sexual Offence Act, 2012.

The prosecution case in, brief, is that on 27.3.2015 at about 3.00 P.M. the informant along with her villager went in the field of Kedar Sah , the petitioner came there and committed rape with her.

It is submitted on behalf of the petitioner that the petitioner is in custody since 30.3.2015. Charge sheet has been submitted in this case. The petitioner has got no criminal

Patna High Court Cr.Misc. No.27539 of 2015 (2) dt.31-07-2015 2/2 antecedent. The petitioner is aged 75 years. The medical report do not support the allegation as made in the FIR. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cumSpecial Judge of POSCO Act,East Champaran at Motihari in Mahila P.S.Case No. 17 of 2015.
