Petitioner seeks bail in a case registered under section 302 and other allied sections of the Indian Penal Code. Sanjay Sing the informant named the petitioner and alleged that accused persons had threatened only because the informant and others had been casting votes in favour of Bhartiya Janta Party. It is further alleged that the accused persons confined Roshan Kumar and on the order of Fulmanti Devi Anup Yadav fired which hit in the eye of Lalan Singh the father of the informant and Lalan Singh died.

Learned counsel for the petitioner submits that there is no specific allegation of firing against the petitioner.

Patna High Court Cr.Misc. No.38806 of 2014 (2) dt.28-01-2015 2/2 Allegation of firing is against Anup Yadav. The petitioner is in jail since 08.05.2014.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of C.J.M, Gaya in Magadh Medical P.S. Case No. 74 of 2014.
