JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-09-2019 This is an application for grant of anticipatory bail in connection with Halsi P.S. Case No. 01 of 2019, disclosing offences under Sections 323, 307, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioners no.1 to 3 is of firing on the informant and his wife, causing injuries to them. So far petitioner no.4 is concerned, there is no specific allegation against him.

Submission of the learned counsel for the petitioners is that the matter has been compromised between the parties. Heard learned A.P.P. also.

No.55688 of 2019(2) dt.03-09-2019 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, so far as, petitioners no. 1 to 3 are concerned, I am not inclined to grant privilege of anticipatory bail to them. However, the petitioner may move before the learned court below for regular bail which will be considered by the learned court below, and if possible, be disposed of on the same day.

So far as, petitioner no.4 is concerned, let the petitioner no.4, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Halsi P.S. Case No. 01 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure With the aforesaid, this application is disposed of.
