1. Heard learned counsel for the parties.

2. The petitioner in this application prays for grant of anticipatory bail apprehending his arrest in connection with Bheja P.S. Case no. 52 of 2020 registered for the offence punishable under sections 307, 379, 147, 148, 149, 341, 323, 324, 325, 448, 427 and 504 of the Indian Penal Code.

3. As per the prosecution case, over a dispute relating to grazing of field, it is stated that 27 named accused persons including the petitioner herein came variously armed and started to assault the informant and others. They were

It is further stated that subsequently they once again gathered and assaulted the informant and others at their house causing injuries as a result of which the injured were treated at D.M.C.H.

4. Learned counsel for the petitioner in reference to the allegations levelled in the FIR submits that the allegations are general and omnibus in nature so far as this petitioner is concerned. The petitioner has been falsely implicated in the case. There is specific allegations on other coaccused. The petitioner who has no criminal antecedent undertakes to cooperate in the investigation/trial.

5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the F.I.R., while there is specific allegation against others, the allegations against this petitioner being general and omnibus in nature and specially the petitioner not having any criminal antecedent, it is directed that the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Bheja P.S. Case no. 52 of 2020 on furnishing

Patna High Court CR. MISC. No.55569 of 2025(2) dt.30-08-2025 3/3 bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Jhanjharpur, Madhubani.
