The petitioner seeks bail in a case registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code.
The allegation against the accused including the petitioner is to have strangulated the deceased, the sister of the informant and her dead body was disposed of.
It is submitted by learned counsel for the petitioner that in the written report only suspicion has been made against the petitioner. During the investigation, the informant has filed a petition in the court of the learned Judicial Magistrate, Ist Class stating therein that after lodging the case, he came to know that the deceased died due to diarrhoea and her treatment was made by the Doctor and later on she was referred to Sadar Hospital, Chapra
Patna High Court Cr.Misc. No.14844 of 2015 (3) dt.01-06-2015 and in the way to the Hospital she died. During the cremation, the informant and his uncle had also participated. The petitioner has no criminal antecedent.
Considering the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Arvind, Judicial Magistrate, Ist Class, Saran Chapra in Taraiya P.S. Case No.77 of 2014 with the following conditions:
1.
One of the bailors will be the close relative of the petitioner.
2.
The petitioner will not indulge in similar or in any other offence.
3.
The petitioner will be well represented in the court.
4.
In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
