The petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120B and 34 of the Indian Penal Code and under Section 27 of the Arms Act. Submission is that the petitioner is not named in the FIR. In para 77 and 78 of the case diary, the daughters of the deceased Navin Singh suspected the hands of the petitioner in killing their father in collusion with one Pintu Sharma. Thereafter, the police took confessional statement of two accused persons in para 157 and 160 of the case diary who are said to have confessed that the petitioner got the deceased Navin Singh killed with the help of Pintu Sharma, a criminal lying in jail. It has come that the

No.26033 of 2015 (4) dt.03-08-2015 2/2 land of the deceased is adjacent to the land of the petitioner and that is why there was enmity between the deceased and the petitioner. Although, the petitioner happens to be cousin (Phuphera brother) of the deceased. Except suspicion and confession there is no other material against the petitioner. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Aurangabad Town P.S.
