This is an application for bail in connection with Hilsa P.S.Case No. 133 of 2017 registered for the offences punishable under Sections 454, 354B, 379 and 376 of the Indian Penal Code including 4/6 of POCSO Act.

Allegation against the petitioner is that he entered inside the house of informant and committed rape upon daughter of informant and later on she has committed suicide and she has given her suicide note.

Submission of learned counsel for the petitioner is that no such occurrence has taken place and there is no eye-witness to the occurrence and he is in custody since 29.3.2017. Heard learned APP also.

Patna High Court Cr.Misc. No.45908 of 2017 (5) dt.14-11-2017 2/2 Having heard both sides and in view of allegation, suicide note of deceased, who was minor, I am not inclined to grant bail to the petitioner. Hence prayer for bail is rejected. However, learned trial court is directed to expedite the trial.
