JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 20.09.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Sasaram (Model) P. S. case no. 58/2016 registered under section 135 of the Electricity Act.

According to the written report of the informant itself, petitioner was working as guard of Tower of Birla Telecom at Durga Chowk, Fazalganj and, therefore, it is obvious that he was not beneficiary to the alleged theft. It is surprising enough that owner of the aforesaid Tower has not been made accused.

Considering the aforesaid facts and circumstances

Patna High Court Cr.Misc. No.57347 of 2018 (2) dt.20-09-2018 as well as submissions of the parties, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sasaram, Rohtas in Sasaram (Model) P. S. case no. 58/2016 subject to condition as laid down under section 438(2) of the Cr.P.C.
