22-07-2015 Heard learned counsel for the petitioner and learned Addl. Public Prosecutor.
This is the second attempt for grant of bail. Earlier, a report was called for from the court below, which has been received and kept at flag "A". The report indicates that out of nine charge-sheeted witnesses, seven have already been examined. Earlier, the prayer for bail was rejected on 04-02-2011, vide Cr. Misc. No. 29839 of 2010, on the ground that the petitioner was the main assailant in a case registered for the offence under Section 302 & other allied sections of the Indian Penal Code. Since, out of nine charge-sheeted witnesses, seven have already been examined, there is no point for extending the privilege of bail to the petitioner.
Keeping in view the fact that the petitioner is in
Patna High Court Cr.Misc. No.25912 of 2015 (3) dt.22-07-2015 2/2 custody since long, it is desirable to observe that the court below may take all steps so that the trial may come to its logical end without any further delay.
The petition stands dismissed.
