The present application has been filed for modification of the order dated 19.07.2018 passed in Cr. Misc. No. 43585 of 2018 to the extent of correction in the father's name of petitioner, Yogendra Poddar as well as for extending the period of surrender.
The petitioner along with five others preferred Cr. Misc. No. 43585 of 2018 with a prayer for anticipatory bail in a case registered for the offences punishable under Sections 341, 323, 504 and 308/34 of the Indian Penal Code. The petitioners were granted anticipatory bail vide order dated 19.07.2018 and it appears that the father's name of the petitioner, Yogendra Poddar,
Patna High Court Cr.Misc. No.52718 of 2018 (2) dt.29-08-2018 who was petitioner no. 2 in the earlier application has been recorded as Ram Narayan Poddar. It has wrongly been mentioned in the Cr. Misc. application as well as in Vakalatnama, hence, the said mistake perpetuated in the order of this Court. Learned counsel for the petitioner is permitted to make necessary correction in the earlier application as well as in Vakalatnama.
The order dated 19.07.2018 is modified to the extent that let the father's name of petitioner Yogendra Poddar be read as late Satya Narain Poddar instead of Ram Narayan Poddar and the period of surrender of the petitioner is extended by two weeks from the date of receipt/production of a copy of this order in connection with Shahkund P.S. Case No. 109 of 2016, pending in the Court of learned Sub-divisional Judicial Magistrate, Bhagalpur.
Accordingly, this modification application is disposed of.
